1: What is the TGA?
The Therapeutic Goods Administration is the government authority that is responsible for evaluating, assessing, and monitoring products that are defined as therapeutic goods. This means the TGA is responsible for regulating medicines, medical devices, and biologicals in Australia in an effort to help people stay healthy and safe. The TGA regulates things like prescription medicine, over the counter medicine, complementary medicine, and medical devices. Regulating these medical products also includes regulating the advertising of them too, which is what this article will focus on.
2: What are the new regulations and what do they really mean?
Recently, the guidance around advertising cosmetic injectables was updated by the TGA, which had implications for the way that we at Cityskin advertise our services. While the legislation regarding cosmetic injectables has not changed, in accordance with the Therapeutic Goods Act 1989, they cannot be advertised to the public.
In practice, the new regulations mean that cosmetic providers can no longer make reference to ‘anti-wrinkle injections’, ‘dermal fillers’ or ‘botox’ where those terms ‘would result in a reasonable consumer understanding the intention of the content is to promote the use or supply’ of such products. So what does this mean? Well, it means that the terms that have been typically used to describe these cosmetic treatments can no longer be used to advertise them.
3: What are the changes that we have made as a result?
As a cosmetic treatment provider, we have legal obligations to comply with the regulations of the Therapeutic Goods Administration, as well as an obligation to our patients and clients to have their safety and health in mind at all times.
